AND 

WHY SEPARATE STRIKE NOTICE

Dear friends,

 

1. Two days strike was highly successful, very effectively displayed the anguish and agonies of bankers beyond cadres.

2. AINBOF- An officer organisation- meant for the officers belong to public sector banks- A sectoral organisation of AIBOC and thus part of the UFBU issued a separate strike notice demanding

A.    Wages as per the MINIMUM WAGES FORMULA as adopted in the   CENTRAL PAY COMMISSION instead of demanding Fair wage revision at this advanced stage.

B.    Wages equivalent to Grade A officers of the Government to the officers as we have been getting during 70s which specifies officers demand and expectation.

C.   Running scale of pay without linking the increment to the promotion so as to avoid stagnation which would very badly affect the 80% of the youth, whose promotions is not in the hands of them.

D.   Updation of pension to ensure the retirees also to lead a decent and safe  life.

E.    Scrapping of NPS to ensure the assured pension to the youths on their retirement.

 

HOW THEASE DEMANDS ARE JUSTIFIED AND WHY IT IS PURSUED CONSISTENTLY  BY AINBOF?

1.    When the banks are facing losses due to the Controller’s policies and the behaviour of borrowers, delinking the salary from the profits and paying capacity of the banks is the best alternate.

2.    It specifies the scientific parameters like nutritional requirements and other factors decides the decent life of workers with the family matching to their status in the banks.

3.    Four officers organisations like AIBOC AIBOA NOBO INBOC have accepted the formula and submitted the charter of demands detailing the advantage of minimum wages formula even before code on wages act was passed in the parliament and gazetted.

4.    All the members gave their mandate to negotiate the wage revision with IBA on the above lines.

5.    International labour organisation (ILO) passed a resolution supporting the above formula in 70s and Indian labour congress passed a resolution in 50’s.

6.    80% of the member countries of ILO are following this formula.

7.    India has also introduced the formula in CPC and the government employees are getting more than us despite the deficit budget.

8.    Government has passed an act favouring this formula and published in the gazette after the draft was vetted by CITU. AITUC and HMS.

9.    If the provisions of the act is implemented there would not be any stagnation and the running scale of pay is automatically ensured which would result in higher basic pay to get higher quantum of pension too.

10. 8th January All India strike where in the Bank employees have participated in full has demanded minimum wages formula and to fix the minimum wages at 21000 to 24000 as minimum wages.

11. High court, Madurai bench has advised the GOI to give reply to the prayer that seeking direction to IBA to negotiate the wages on the minimum wages formula with the the trade unions is yet to be responded by the GOI.

12. Meanwhile, IBA has submitted a counter in the high court Madurai stating that IBA is not the statutory body to agree or enter in to an agreement with the trade unions on wage revision and they are only a facilitator which questions the legal validity of even the previous ten settlements.

13. Respondents are relying on a legal opinion which suggests that though the act is gazetted, it will come into effect after the provisions are notified.

14. Kindly note that the legal opinion did not say that the act is not applicable to the bankers, rather, they opined that the act is covering us also if the provisions are notified.

15. As a response to an appeal under RTI, the labour ministry responded that the act is universal to apply to the workforce and will be effective from the date of notifying the provisions of the act.

16. Neither the Government nor IBA could say the reasons for non application of  the minimum wages formula on the lines of CPC to the Bankers despite various representations thorough various modes.

17. Recent media news that that the government is not keen on notifying the provisions of the Act as the private corporates  will be in trouble suggests the monetary benefit and robustness of the act.

 

AINBOF wonders

 

A.   When the listed above are the legal and logical reasons for pursuing our original demands of  COD for the which the mandate was given by all the members, why we should fall prey to the percentage game?

B.   Whether the salary fixed on the percentage basis linked to the paying capacity is better than the Minimum wages formula? It is proved otherwise many a times.

C.   When the minimum salary for the decent life is settled as per the minimum wages formula, we need not worry much on the performance linked incentive also.

D.   When the provisions are notified, the act will come into stay and then What could we do?

E.    Is it not true that when the provisions are notified, the permanent scientific formula will come into effect which would facilitate us to settle our wages directly with the appropriate government as notified by the act and in our case it is DFS?

F.    When we are getting DA increase every three months, recently got one month’s salary towards possible arrears and offer by IBA will result in an actual increase of 2 to 2.25% through load factor only, why we can’t wait for some more time to get a QUALITY SETTLEMENT?

G.   Other than the disbelief on our part on the paying capacity, can anybody list out any other reasons for the denial of the minimum wages formula and equivalent pay of  Grade A officers to the Bank officers?

 

So,

Dear friends,

You have bravely expressed your anguish unitedly to get decent wages through out the country by an unprecedented act, but the IBA did not understand our real intention to RECRUIT AND RETAIN talents in order to strengthen the financial industry – a blood line to the better economy and in turn strong nation.

If our armed forces are guarding the borders from the external invasions, it is the Bankers are preventing the economical disasters and protecting the nation.

The DEMANDS of the AINBOF needs all round support from all the cadres in the Banking industry.

I request all of you to spare a few minutes to browse and come out with honest, conscience and independent view on this  important issue.

It is not too late and even now the negotiators can renew their dialogue on the demands of our well documented COD which is the dream of all BANK OFFICERS.
